LEUVEN WALKS GENERAL TERMS AND CONDITIONS

For Leuven Walks activities, the general Terms and Conditions of Leuven Leisure are applicable; it should be noted that this English language translation is offered as a friendly service and that, according to Belgian law within Flanders, any establishment of a legally binding contract is completed only through Dutch-language contracts.  If the customer signs an English-language contract it is assumed that they understand and also agree to the Dutch-language contract, thus making their agreement with the terms of the contract legally binding.  Any error in the nuances of translation is inconsequential and the local language contract takes full precedence over this version.

TERMS LEUVEN LEISURE

1. REGISTRATION

A registration is done by the confirmation via email and/or filling out the registration form. In this way, agreement for participation in the program is established between the customer and Leuven Leisure. Even if payment has not yet occurred, between the customer and Leuven Leisure an agreement exists for the organization of the relevant activity or activities applied.

2. SALES

Leuven Leisure shares the cost of the activity for which the customer has registered and informs the customer prior to the execution of the program.
Unless otherwise stated or agreed otherwise, the sales prices are exclusive of VAT.
The prices include only the services and facilities discussed through the e-mail and or agreed in the reservation form.

Leuven Leisure reserves the right to adjust the agreed prices and levy fees due to late (less than a week before the activity or tour) changes to the program made by the customer.
If the customer does not respect the agreed start time of the day for an activity and is at least fifteen minutes late, Leuven Leisure reserves the right to charges the customer for the delay or cancel the activity even completely.

3. PARTICIPANT NUMBERS AND PAYMENT

It is the responsibility of the customer at least one week prior to the implementation of the program to communicate the precise and unchanging number of participants in a Leuven Leisure activity. If the customer requests an invoice, Leuven Leisure, on the basis of this customer information obtained about the number of participants, includes the numbers in the final bill and sends it before or after the execution of the program to the client for payment. Leuven Leisure offers no refunds due to a decrease in the number of participants; it is the responsibility of the customer one week before the start of the program to communicate the correct information about the number of participants. A (partial) refund will only be issued if Leuven Leisure has made a demonstrable mistake or error regarding the content of the bill. If the customer requests an invoice, Leuven Leisure, on the basis of this customer information obtained about the number of participants, will be paid the fixed amount which calls for immediate payment by bank transfer.

When the customer cannot provide the exact number of participants for any reason one week prior to the implementation of the program, Leuven Leisure calls for the immediate payment of a deposit.  Leuven Leisure determines the amount of this deposit. Leuven Leisure does not provide invoices in advance; the advance payment (deposit) will be deducted from the final bill or deducted from the balance that is paid via a simple bank transfer.

When the customer requests an invoice, payment must in any case be received by Leuven Leisure for the commencement of the execution of the activity.
Invoices are payable to the address of the Leuven Leisure association, at the latest 15 days after the invoice date. Non-payment of the balance can dissolve the entailed agreement. In the absence of payment of the invoice or incomplete payment, Leuven Leisure reserves the right, without notice and upon the expiration of the deadline, to charge a late fee of 10% per year on the amount from the date of invoice, and an irreducible compensation of 10% on the invoice amount, with a minimum of 50 euros.
The tenderer who enrolls other participants is jointly and severally liable with the group for the fulfillment of their obligations to Leuven Leisure.

4. CANCELLATION / CHANGE BY CUSTOMER

In the event that a customer cancels the agreement made, Leuven Leisure will compensate the customer for this. The cancellation costs are estimated as follows:
* Up to 30 days prior to the activity: 25% of the price per program
* Up to 15 days before the event begins: 50% of the price per program
* Up to 7 days before the event begins: 75% of the price per program
* Less than 7 days before the event begins: 100% = full price per program
Already paid and full invoice amounts shall in any case remain in the possession of Leuven Leisure. The advance payments are deducted as appropriate on the cancellation costs.

Leuven Leisure reserves the right to adjust the agreed prices and charge fees due to late (less than a week before the performance) changes to the program because of the customer.

The correct number of participants in an activity must be provided by the customer to Leuven Leisure at least one week before the start of this activity. When, for any reason, the customer cannot provide the exact and unchanging number of participants at least one week prior to the implementation of the program, Leuven Leisure calls for the immediate payment of a deposit in the amount which Leuven Leisure determines.. Leuven Leisure does not offer invoices in advance; the advance payment deposit will be deducted from the final bill or deducted from the balance that a simple transfer is paid.
Less than a week before the implementation of the program the pre-agreed number of participants is fixed. Leuven Leisure offers no store credit refunds nor does Leuven Leisure offer refunds relating to participant numbers that are decreased during the time period that is less than a week before the start of implementation of the program. There are only two exceptions: a doctor's certificate that proves the participant is too sick to take part in the activity or another clear demonstration of force majeure: in these cases Leuven Leisure may decide to make a refund and or offer a credit note. This refunding, rescheduling, or crediting can only occur once: a reduction in the number of participants along with the supporting documents should immediately be transmitted to Leuven Leisure when it is known that the participant will not take part and will decrease the number of participants in the activity.
Any last-minute increase in the number of participants, of course, increases the total price. The customer is informed by Leuven Leisure of the price increases or additional registered participants may or may not be included in the activity.

If the customer does not respect the agreed start time of the day and is at least fifteen minutes late, Leuven Leisure reserves the right to charge the customer for the delay or cancel the activity even completely.

Customer-requested changes are accepted into a Leuven Leisure program where possible and subject to payment of costs and / or of any price adjustment for these program personalizations.

In case of a climatic force majeure such as a natural disaster or an entirely excessive extreme weather conditions (eg, thunder and lightning, extremely large balls of hail), the customer can choose to move the activity in consultation with Leuven Leisure to a later date. Only Leuven Leisure can make the decision to cancel in these circumstances; the client can not. The customer may never request refund in these circumstances. With any climatic condition (also rain or snowfall) the activity continues and can not move it to a later date or canceled or refunded. The customer can guard against the anticipation of bad weather by advance agreement with Leisure Leuven regarding the development of an alternative or “bad-weather” program that can be used last minute.

The cancellation conditions for the activities of Leuven Floats are different: for special cancellation conditions see http://leuvenfloats.leuvenleisure.com/

Participants agree to bear the cost of any damage caused by non-compliance with instructions from our guide or guides.

9. USE / RENT OF MATERIAL LEUVEN LEISURE

Barring exceptions, the rental equipment is property of Leuven Leisure. We therefore reserve the right to charge for damage costs. The costs resulting from the damage are contingent upon the damage caused by a participant; failure to properly follow the instructions of the guide(s), or when not acting as a good steward of the material, are always at the expense of the participant . Under all circumstances other than those for which the error of the supervisor may be established, loss or damage of material by the user is the responsibility of the user and the participant must be willing to reimburse these costs.

If Leuven Leisure equipment is rented for individual trips without the use of a guide, we may charge a cash deposit upon collection of the rental(s). This deposit is factored in by Leuven Leisure in case of damage or loss of the equipment. In the case of complete loss or theft of the equipment, the full commercial value of the equipment is charged. The customer can always protect themselves by taking out appropriate insurance with their insurance agent.

The cost of damage or loss of equipment is estimated by an expert depending on the damage or loss.

10. COMPLAINTS

Despite all our precautions, it is possible that you as a customer may still believe you have a justified complaint. This complaint must be submitted on the spot in question to the facilitator or guide(s), so he or she is able to immediately seek a solution. If this is not possible, or the complaint is not satisfactorily resolved, any complaints must be submitted to Leuven Leisure at the latest within three days after the activity in writing and registered with the necessary explanations.

In the case of any dispute, only the courts within Leuven’s jurisdiction and only Belgian law apply. If the above conditions are different from the terms of the tender, they will take precedence over those of the tenderer.
